01Interpretation and Definitions
1.1 Interpretation

Capitalized terms have the meanings provided in this Section or otherwise defined in these Terms. Definitions apply regardless of whether terms appear in singular or plural.

1.2 Definitions
  • Affiliate — any entity that controls, is controlled by, or is under common control with Macrolytix, where "control" means ownership of at least 50% of equity interests or voting securities.
  • Application — the mobile application titled "Kcalytix," including all related features, tools, content, and updates.
  • Company / We / Us / Our — Macrolytix.
  • Device — any device capable of accessing the Service.
  • Service — collectively, the Application, associated software, content, AI-powered tools, and any services offered by Macrolytix.
  • User Content — any images, photographs, text, metadata, or other content uploaded or submitted by You through the Service.
  • You — the individual using the Service or the legal entity on whose behalf the individual uses the Service.
02Agreement to Terms

Your access to and use of the Service is conditioned upon Your acceptance of these Terms and the Kcalytix Privacy Policy. By accessing or using the Service, You acknowledge that You have read, understood, and agreed to be bound by these Terms. If You do not agree, You must discontinue use of the Service.

03Eligibility and Age Requirements

You represent and warrant that You are at least 13 years old.

If You are between 13 and 17 years old, You may only use the Service with the consent and supervision of a parent or legal guardian, who agrees to be fully responsible for all activities conducted using the Service.
04Health, Nutrition, and Safety DisclaimersImportant

Kcalytix does not provide medical advice, nutritional counseling, or professional health services. All calorie estimates, nutritional insights, and food identifications are automated approximations and may be incomplete or inaccurate.

  • Calorie and nutrition estimates are approximations only.
  • The Service is not intended to diagnose, treat, cure, or prevent any disease.
  • You should consult licensed professionals for dietary or medical guidance.
  • Macrolytix is not liable for inaccuracies in calorie counts or food identification.
05User Content and License Grant

By submitting User Content, You represent that You own or have the necessary rights to it. You grant Macrolytix a worldwide, irrevocable, royalty-free, transferable, sublicensable license to use, reproduce, analyze, process, modify, and create derivative works from the User Content to operate and improve the Service, including for AI model training.

You agree not to upload unlawful, harmful, offensive, or infringing content.
06Prohibited Uses

You may not use the Service to:

  • Upload violent, explicit, or unlawful content.
  • Reverse engineer or conduct competitive analysis of the Service.
  • Circumvent security protections or attempt unauthorized access.
  • Upload images of individuals without their lawful consent.
  • Interfere with or disrupt the operation of the Service.
  • Use the Service in any manner that violates applicable laws or regulations.
07Subscription, Billing, and In-App Purchases

Purchases and subscriptions are processed through third-party platforms such as the Apple App Store and Google Play Store. Their respective terms govern payment processing, renewals, and refunds.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
08Third-Party Services

The Service may include links or integrations with third-party content or services. Macrolytix does not control and is not responsible for the practices, content, or availability of such third-party services. We encourage You to review their privacy policies and terms before use.

09Intellectual Property

All rights in the Service — excluding User Content — are owned exclusively by Macrolytix or its licensors. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service without Our prior written consent.

10Termination

Macrolytix may suspend or terminate Your access to the Service at any time if You violate these Terms. Upon termination, all rights and licenses granted to You under these Terms immediately cease.

11"AS IS" and "AS AVAILABLE" DisclaimerLegal

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied. Macrolytix expressly disclaims all warranties, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

12Limitation of LiabilityLegal

To the maximum extent permitted by applicable law, Macrolytix's total liability shall not exceed the greater of: (a) the amount You paid in the preceding 12 months, or (b) one hundred Indian Rupees (INR ₹100).

Macrolytix is not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill, even if advised of the possibility of such damages.
13Copyright and DMCA

If You believe that Your copyright-protected work has been used in a way that constitutes infringement, please contact Us at support@kcalytix.in with the details of your claim. We will respond to valid notices in accordance with applicable law.

14Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

15Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to the Service or these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with applicable Indian arbitration laws. Class actions and representative actions are not permitted.

16Severability and Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Failure by Macrolytix to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

17Changes to These Terms

Macrolytix may update these Terms at any time. Material changes will be communicated through the Application or by email. Continued use of the Service after updates constitutes Your acceptance of the revised Terms.
